CANCELLATION, RESCHEDULE, AND REFUND POLICY:
1. Cancellation:
General Cancellation: In the event of a total cancellation due to any reason, including acts of God, strikes, riots, pandemics, or other unforeseen circumstances, 50% of the booking amount will be non-refundable.
Specific Event Cancellation: Should any specific event be canceled, the client must fulfill the payment terms as outlined in the Service Agreement. Payment and terms might be reconsidered upon mutual agreement (see point 6: Payment & Terms).
2. Reschedule:
The initial quotation remains valid for one year from the date of the 1st event. After this period, a revised quotation will be provided, with prior payments adjusted.
Clients should inform the contractor of rescheduled dates at least two months in advance.
If the notification comes less than two months before the new dates, service delivery depends on the contractor's availability. If services can't be delivered, the booking amount is non-refundable.
3. Non-Acceptance of Deliverables: If the client chooses not to accept any of the deliverables, no refunds or adjustments will be provided.
LIABILITY:
1. Service Failure: If the contractor cannot deliver services due to equipment failure, accidents, illnesses, or other unforeseen reasons, any fees paid by the client will be refunded.
2. Damage or Loss: Limitation of liability applies in case of loss or damage of photographs/videos unless due to an intentional error by the contractor.
3. Refund Limitation: Any refund terminates further liabilities, and the maximum liability shall not exceed the fees paid by the client.
4. Digital Reputation: After receiving a refund, clients cannot post negative comments about the contractor on digital platforms.
5. Equipment Assurance: All necessary steps are taken to ensure equipment functionality and to maintain backups.
6. Service Provisions: If no images or films can be delivered for specified reasons, a full or partial refund, proportionate to the services provided, will be issued.
COVID TERMS:
If the wedding is held at a temple or home with a gathering of 20 people, a revised quotation with adjusted deliverables will be provided.
For larger gatherings, irrespective of size, the original costing remains unchanged.
GENERAL PROVISIONS:
Clients must follow safety, security, and hygiene protocols.
If safety is compromised due to violence or threats, the contractor may terminate the agreement.
While the contractor ensures coverage of all guests, non-cooperative guests aren't the contractor's liability.
In the event of marital disputes, no refunds will be issued.
All raw data is deleted after two years post-event.
Client instructions are to be channeled through a designated point of contact.
Weather-related constraints (e.g., rain) may impact service delivery.
Quotations, image counts, or video lengths are approximations and may vary.
Clients must provide accurate event timings.
Wedding coverage specifics, including timings and additional charges, are defined.
JURISDICTION AND DISPUTE RESOLUTION:
Any disputes arising from this agreement will be resolved through arbitration as per the Arbitration and Conciliation Act 1956. A sole arbitrator appointed by the contractor will manage this. For legal disputes, jurisdiction lies in Varanasi, Uttar Pradesh.
Please ensure you consult with a legal professional when finalizing any contracts or agreements to ensure they meet all necessary legal standards and requirements.
